AIpointment.ai Terms of Service

These Terms of Service ("Agreement") are entered into by and between you (“Client” or “you”) and

AIpointment.ai, a California-based company (“AIpointment,” “we,” “our,” or “us”). This Agreement governs your access to and use of our services, including our AI-powered appointment setting tools, advertising management, and CRM integrations (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree, you may not use the Services.

1. Services Provided

1.1 Service Scope

AIpointment.ai offers client acquisition solutions, including Facebook ad management, AI chatbot and voice follow-up, CRM syncing, and automated appointment scheduling systems for real estate professionals.

1.2 AI Interaction

You acknowledge that part of the service includes AI-driven outreach, messaging, and call handling. You agree that AIpointment is not responsible for individual customer reactions or responses generated during these interactions.

2. Client Responsibilities

2.1 Content & Access

You agree to provide timely access to your ad accounts, CRM, or other platforms required to deliver the Services. You are responsible for providing accurate business information, access credentials, and any custom messaging content.

2.2 Compliance

You are solely responsible for complying with advertising and communication laws applicable in your jurisdiction, including Do Not Call (DNC) regulations and data privacy requirements.

3. Payment & Subscription

3.1 Fees

All fees are outlined in your signed proposal, onboarding agreement, or invoice. AIpointment does not publish standard pricing in its Terms of Service, and rates may vary based on the scope of services agreed upon.

3.2 Billing & Refunds

Payments are non-refundable unless explicitly stated in writing. Delays in onboarding or campaign setup caused by client-side inaction do not pause the billing cycle. If your card fails or payment is not received on time, your account may be paused until the issue is resolved.

4. Intellectual Property

4.1 Ownership

AIpointment.ai retains all rights to the systems, AI models, ad templates, scripts, and internal processes used to deliver services. You may not copy, reproduce, or distribute these tools outside your business without written permission.

4.2 Client Materials

You retain rights to any logos, brand assets, or custom content you supply. By providing them, you grant us a license to use them for the purpose of fulfilling the Services.

5. Confidentiality

We agree to maintain confidentiality of your business strategies, client data, and campaign performance. You agree to the same regarding our processes, pricing, and internal technology.

6. Disclaimer of Warranties

We provide our Services “as is.” We do not guarantee a specific number of leads, appointments, or conversions, unless explicitly stated in your signed package. External factors (market, budget, response rates) may impact performance.

7. Limitation of Liability

To the maximum extent permitted by law, our total liability will not exceed the amount you paid us in the last 60 days before the claim. We are not liable for indirect damages, including loss of revenue, business interruption, or data loss.

8. Termination

Either party may terminate this Agreement with 30 days’ notice. If terminated early, you remain responsible for the full agreed payment unless otherwise stated. AIpointment may suspend or terminate access immediately in cases of abuse or misuse.

9. Modifications

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

10. Governing Law

This Agreement is governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in San Francisco County, California.
